Some doctors suing ObamaCare.
Another group has joined the majority of Americans in opposing the unprecedented expansion of Government mandates, this group represents American Physicians and Surgeons. In fact, it has not only joined us in recognizing that a Federal government cannot force it's citizens to purchase something for the sake of a common good, but is suing the Obama Administration. In a press release issued by the AAPS, some of our doctors are warning that the quality of our case and overall sense of freedom are in danger of being compromised.
AAPS further underscores the underlying theme of why this piece of legislation violates the Constitution, a document that every member of Congress (and President) swears to uphold.
Beyond the issues of legality there is also the inconvenient matter of funding another entitlement program and the AAPS points out:
Now yes, there will be some doctors who endorse and support ObamaCare and there will be some who oppose it. In order to understand why a division like this exists, please do not forget that doctors are human beings. Therefore there are good doctors, bad doctors, excellent doctors, stupid doctors and smart doctors. Not every person is equally talented and neither is every doctor and therefore just like there are teachers, businessmen, executives, car manufacturers, there are doctors who see the Government as a means to advance their career.
We bemoan the large corporations in America and the large commercial banks that have taken the taxpayer hostage, but before you declare war on capitalism and assume every businessman is evil, remember that the line between the private sector and the public sector is getting blurrier by the second. For decades large corporations have used the heavy hand of government to bludgeon their competition, for decades powerful lobby groups have used their influence and money to gain special privileges from Congress and doctors are no exception. Just like there were doctors who cheered and fought for Medicare and Medicaid, there will be doctors who will fight and cheer for ObamaCare.
Why? Because it levels the playing field. It allows mediocre doctors, doctors who should not and would not stay in business to acquire legions of new patients. A contract with the Federal Government is an excellent source of revenue and an entitlement program that guarantees unlimited amount of health care consumption is even better. Of course the only winners in this situation are those doctors that do not wish to compete in a free market system, losers that cannot make it without outside intervention. Doctors who do oppose ObamaCare are the only legitimate professionals this country has to offer, every one else should hang up their white coat and retire in shame. That is right, there are legitimate people with legitimate reasons that oppose the Statist agenda of Pelosi-Reid-Obama and not some pathetic backlash rooted in bigotry that NYT would like you to believe.
It would be quite telling if we start seeing "I oppose ObamaCare" on the doors of doctor's offices, as those would be the offices I would recommend frequenting.
“If the PPACA goes unchallenged, then it spells the end of freedom in medicine as we know it,” observed Jane Orient, M.D., the Executive Director of AAPS. “Courts should not allow this massive intrusion into the practice of medicine and the rights of patients.”
AAPS further underscores the underlying theme of why this piece of legislation violates the Constitution, a document that every member of Congress (and President) swears to uphold.
The PPACA also violates the Tenth Amendment, the Commerce Clause, and the provisions authorizing taxation. The Taxing and Spending power cannot be invoked, as the premiums go to private insurance companies. The traditional sovereignty of the States over the practice of medicine is destroyed by the PPACA.Bravo! Unless we wish to descend into full fledged anarchy, we need to recognize that we are a nation governed by laws and these laws must be upheld! Not to be tossed aside to fulfill a Statist agenda that happened to crawl up the Socialist-in-Chief's behind.
Beyond the issues of legality there is also the inconvenient matter of funding another entitlement program and the AAPS points out:
AAPS notes that in scoring the proposal the Congressional Budget Office (CBO) was bound by assumptions imposed by Congress, including the ability to “save” $500 billion in Medicare, and to redirect $50 billion from Social Security. HHS Secretary Sebelius stated that PPACA would reduce the federal deficit, knowing the opposite to be true if these assumptions are unrealistic.Indeed. Using the CBO data is impossible as they simply make assumptions on costs based on what they are given and if they are given a bunch of promises that are impossible to realize then their cost projections are moot. This is partially why every single cost projection made by our ruling elite falls squarely on it's ass while the taxpayers foot the actual bill.
